Acceptance of Terms

By accessing or using the website of Mosquit Nope LLC (“Company,” “we,” “our,” or “us”), you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree, you must not use this website.

Usage By Minors

These Sites are not intended for or directed to persons who are minors (typically persons under the age of 18, depending on where you live). Because we cannot prohibit minors from accessing the Sites, we must rely on parents, guardians, and those responsible for supervising minors to decide which materials are appropriate for minors to view. By registering with the Site or providing us with any information, you represent to us that you are legally permitted to enter into a binding contract (18 years of age or older in most jurisdictions) or, if you are under the legal age of consent, you have the express permission from your parent or guardian and that any information you provide to us is not inaccurate, deceptive or misleading.

Services Disclaimer

We provide mosquito control and related pest services. While we strive to reduce mosquito populations, we do not guarantee the complete elimination of mosquitoes. Results may vary based on weather, property conditions, standing water, and neighboring properties.

Customer Responsibilities

To help ensure the effectiveness of mosquito control services, the Customer agrees to properly maintain their property by eliminating standing water and keeping the yard in suitable condition. This includes removing or addressing items that may collect water, such as buckets, toys, tarps, containers, bird baths, plant saucers, flowerpots, clogged gutters or drains, old tires, debris, and any low areas where water may accumulate. The Customer also agrees to maintain yard conditions by keeping grass reasonably trimmed, reducing dense vegetation where mosquitoes may rest, and keeping the property free of excessive clutter or debris. In addition, the Customer agrees to ensure proper drainage to prevent water buildup and to follow any preparation instructions provided by Mosquit Nope LLC prior to treatment. The Customer acknowledges that failure to maintain the property as described may significantly reduce the effectiveness of services, and Mosquit Nope LLC shall not be responsible for reduced results due to such conditions.

Scheduling, Access, Service Refusal & Additional Fees

Mosquit Nope LLC reserves the right to refuse, cancel, or discontinue service at its discretion. Customers are required to provide safe and reasonable access to the property for the completion of services. If service cannot be performed due to access issues, including but not limited to locked gates, unsecured pets, or unsafe conditions, the Customer agrees that the full service fee for that scheduled visit may still be charged. Mosquit Nope LLC also reserves the right to refuse or discontinue service if a customer engages in inappropriate, aggressive, unsafe, or disrespectful behavior toward staff.

If service is canceled while at the property due to the conduct of the Customer, property owner, resident, guest and/or family of the customer, property owner and/or resident, the Customer agrees that the full service fee for that day will be charged regardless if the service was completed and Mosquit Nope LLC reserves the right to assess an additional reasonable fee, up to 50% of the scheduled service cost, for unsafe, hostile, or inappropriate behavior toward staff.

Payment Terms

Payment is due as agreed at the time of service or booking. Late payments may result in suspension of services until the account is brought current. Any unpaid balance may be subject to a late fee of up to 1.5% per month (18% annually), or the maximum rate allowed by Georgia law, whichever is less, which will continue to accrue until the balance is paid in full. Mosquit Nope LLC reserves the right to charge cancellation fees or missed appointment fees where applicable.

Limitation of Liability

To the fullest extent permitted by Georgia law, Mosquit Nope LLC shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of use, loss of profits, or damage to property. Mosquit Nope LLC shall also not be liable for any injuries, damages, or conditions resulting from factors outside of its control, including but not limited to untreated areas, environmental conditions, neighboring properties, or failure of the Customer to maintain the property as required.

Property & Treatment Risks

Customer acknowledges that pest control services involve the application of products and that temporary odors or residue may occur as a result of treatment. Customer further understands that outdoor treatments are subject to environmental conditions, including but not limited to rain, temperature, and surrounding factors, which may impact the effectiveness and duration of results. Mosquit Nope LLC shall not be responsible for any reduction in effectiveness or other outcomes caused by environmental factors or conditions beyond its control.

Indemnification

Customer agrees to defend, indemnify, and hold harmless Mosquit Nope LLC from and against any and all claims, damages, losses, liabilities, and expenses arising out of or related to the Customer’s misuse of the website or services, failure to follow service instructions, or conditions on the Customer’s property.

Intellectual Property

All website content (logos, branding, text, graphics) is owned by Mosquit Nope LLC and may not be used without permission.

User Conduct

Customer agrees not to use the website for any unlawful or illegal purposes, to attempt to hack, scrape, or otherwise disrupt the functionality or security of the website, or to submit any false, inaccurate, or misleading information through the site or in connection with services.

SMS/Text Messaging

By providing your phone number, you consent to receive text messages from Mosquit Nope LLC, including appointment reminders, service updates, and promotional communications. You may opt out of receiving text messages at any time by replying STOP. Message and data rates may apply.

Third-Party Links

We are not responsible for content or policies of third-party websites linked from our site.

Changes to Terms

We may update these Terms at any time. Continued use of the website means you accept the updated Terms.

Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to conflict of law principles. By using this website or our services, you agree that any dispute, claim, or controversy arising out of or relating to these Terms or our services shall be resolved through binding arbitration rather than in court, except that either party may bring claims in small claims court for missed payments and/or fees, or seek injunctive relief for misuse of intellectual property. All claims must be brought on an individual basis, and you agree that you may not participate in a class action, act as a class representative, or join claims with others. You further waive your right to a jury trial and agree that disputes will be resolved through arbitration instead of a court proceeding.

Before initiating arbitration or filing a claim in small claims court, both parties agree to attempt to resolve any dispute informally by contacting Mosquit Nope LLC at 219-767-6673. Mosquit Nope LLC is committed to working in good faith to reach a prompt, low-cost, and mutually beneficial resolution. As part of this process, either party may request a telephonic conference, and if represented by counsel, such counsel may participate, but the party must also personally participate. The parties agree to attempt informal resolution for a period of 30 days before proceeding further.

To initiate informal dispute resolution, a party must provide written notice to the other party. Notice to Mosquit Nope LLC must be sent by email to Admin@MosquitNope.com or by mail to 642 Arbor Ridge, Loganville, GA 30052, and must include the sender’s name, telephone number, mailing address, email address associated with any account, the contact information of any legal counsel if applicable, and a description of the dispute. Mosquit Nope LLC will send its response and any corresponding notice to the contact information on file. The informal dispute resolution process will last 45 days and is a mandatory precondition to initiating arbitration or small claims proceedings. Each dispute must be handled individually unless otherwise agreed, and applicable statutes of limitation and filing deadlines will be tolled during this period.

If the dispute is not resolved through informal means, it shall be resolved through binding arbitration conducted in the State of Georgia before a neutral arbitrator. The arbitrator’s decision shall be final and binding on both parties. Each party shall bear its own attorneys’ fees and costs unless the arbitrator determines that a claim or request was frivolous or brought for an improper purpose under applicable legal standards. If either party must seek a court order to compel arbitration, the prevailing party in that action shall be entitled to recover its reasonable costs, disbursements, and attorneys’ fees incurred in enforcing arbitration.

Severability

If any part of these Terms is found invalid, the rest remains enforceable.
